Welcome to the e-commerce site www.vazart.co, hereinafter ("The Site" or "Vazart.co"), established under Colombian laws, whose main activity is to allow the exhibition and commercialization of products and services for online acquisition by consumers located in the Republic of Colombia, hereinafter ("the Customers" or "the Users").
Vazart.co is controlled and operated by VazART, hereinafter ("VazART"), a company domiciled in the Republic of Colombia. Those Users who decide to access the Site from other countries will do so on their own initiative and it is their responsibility to comply with the applicable local laws. Any claim regarding the use of the Site and the material contained therein is governed by Colombian laws.
Users who access the vazart.co site from countries other than the Republic of Colombia may make purchases subject to Colombian regulations; however, products will only be delivered within Colombian territory to the address provided by the user.
By entering the Site, the User acknowledges having read and understood the Terms and Conditions of Use, hereinafter ("Terms and Conditions"), and consequently assumes the obligation to respect its content, privacy policy, legal notices, and all disclaimer clauses contained therein.
These Terms and Conditions are subject to change without prior notice, at any time, and from the date of modification of these Terms and Conditions, all operations entered into between Vazart.co and the User will be governed by the modified document.
1. User Registration on the Site
During the registration process on the Site, the following personal information will be collected:
- Contact information, including name, identification number, date of birth, postal address, telephone number, and email;
- At the time of payment, credit card number and billing and/or shipping information may be requested;
- Recipient's identification number if it is a person other than the User;
- Information related to personal interests and product preferences.
- The User can find information regarding Habeas Data in point 16.
2. User Capacity
Vazart.co services are only available to individuals who have the legal capacity to contract according to current Colombian legislation. If the User lacks such legal capacity, they will not be able to make transactions on the Site.
3. User Verification - Prohibition of Use
By accessing this site, the User agrees to provide accurate and truthful personal information for the effective delivery of purchased products. Vazart.co will examine the application submitted by the User and reserves the right to verify the data provided by each User. If an inconsistency is found in the User's information at the time of registration, or if they fail to notify of any changes, Vazart.co may proceed with the cancellation of the order and the immediate termination of the User's account. In the event that the User has any outstanding amount, it must be paid in full before the account can be closed.
4. User Responsibility
The User undertakes to promptly notify the corresponding financial or cooperative entity of the loss or theft of their credit card and other instruments provided by them to carry out transactions, such as debit cards, personal keys, etc., so that such instruments can be disabled.
The User is prohibited from transmitting or sending from this Site any illegal, threatening, libelous, defamatory, obscene, scandalous, pornographic, and/or any other material that could give rise to any civil or criminal liability under the terms of the Law. Likewise, the User agrees not to use any device, software, among others, to obstruct the proper functioning of the Site and its contents and the activities carried out therein.
5. Products and/or Services
Vazart.co primarily offers its Users accessories for mothers and babies.
5.1. Product Display
Vazart.co displays product images with the greatest possible clarity and precision. However, the color display of products will depend on the monitor from which the Site is accessed.
5.2. Product Availability
Vazart.co is responsible for updating the page and constantly reviewing the products and/or services displayed on the Site. However, Vazart.co may modify and discontinue products and/or services at any time without incurring any liability to the Site Users.
5.3. Quantity Limitation and Order Restriction
The Site may, at its sole discretion, limit or cancel the quantities purchased by a Customer when the purchase does not comply with the conditions and restrictions informed at the time of purchase. In such a case, Vazart.co will flatly reject purchases that exceed the maximum number of units authorized for one (1) identification number. This means that a person identified in accordance with the Laws of the Republic of Colombia may make purchases, per day, for the maximum authorized number as appropriate. Such restrictions may include orders placed from the same account registered on the Site, payments made with the same credit and/or debit card, and orders with the same shipping or billing address.
7. Payment Conditions
The price to be paid for each item purchased will be the price current on the Site at the time of placing the order.
Before Vazart.co accepts any purchase offer, the Customer must choose the payment terms and conditions according to the payment methods established on the Site. Vazart.co provides Users with a secure connection system for carrying out transactions on the Site. However, in no case will it be responsible for failures in the communications of banking or credit entities, nor for damages caused to the Customer due to an action or omission by said entities.
Once the Site verifies the payment, it may proceed to accept the purchase offer. In any case, even after payment has been verified, Vazart.co may deny the acceptance of a purchase offer or accept it partially, in which case it will only be obliged to refund the Customer, without any interest or return, the amount paid for the unaccepted purchase offer or the percentage corresponding to the unapproved part of a partially accepted purchase offer.
8. Payment Information
Among the alternatives contemplated on the Site for the payment of selected products, Vazart.co provides Users with a link that connects to the respective payment gateways authorized by the Site. In such cases, the handling of personal information will be the sole responsibility of the payment gateway. Users must accept the Terms and Conditions of Use of the payment gateway before making their transactions.
9. Promotional Coupons
Unlike credit or debit cards, promotional coupons used in digital coupons are debited when the order is placed. Digital coupons can be automatically redeemed for the total amount of a purchase and must be used in a single transaction, taking into account the specified expiration date. The coupon's expiration date does not change.
Likewise, Promotional Coupons will be taken into account in case of cancellation or return of the purchase for the same value of the acquired product. Promotional Coupons will not be replaced in case of loss or theft. If there is a price reduction below the coupon value, Vazart.co will not refund the excess value.
10. Perfection and Transfer of Ownership
The contract is perfected when Vazart.co accepts the purchase offer presented by the Customer. Vazart.co may partially accept purchase offers, in which case the contract will be perfected only for the products and/or services accepted by the Site.
In the event that the price of the products and/or services subject to a purchase offer is not paid, it will be understood that there is a breach of contract, which is grounds for termination by Vazart.co, with the Customer assuming the cost of returning said products and/or services to the respective warehouse, as well as the amount of damages resulting from such breach.
11. Shipping Charges and Taxes
The Customer will be responsible for the shipping, handling, and insurance charges for the products and/or services purchased on the Site, as well as sales tax, value-added taxes, and other levies that arise from each accepted purchase offer. All taxes incurred by the purchase will be calculated from the moment the Customer places their purchase offer on the Site, and therefore they will know the exact amount they must pay to Vazart.co, which will include all the concepts mentioned.
Regarding imported products, the Customer will assume the taxes and levies that arise from the import of products purchased abroad. However, taxes associated with products may be subject to variations, in case of eventual verifications by Colombian customs authorities. Should an additional cost arise in the import of the product, this will be assumed by the Customer.
9. Product Delivery
Vazart.co undertakes to make deliveries exclusively within Colombian territory, in the areas and places to which it has access according to its network, and therefore may refuse to accept a purchase offer when the address registered by the Customer for delivery is not within the geographical areas enabled by Vazart.co for this purpose.
The products purchased by the Customer will be delivered to the address provided by the customer when making their purchase offer, within a period that can be between 5 and 7 business days depending on the destination, counted from the date on which the Site accepts the corresponding purchase offer, and provided that the payment terms and conditions have been determined in advance and there are no causes beyond the control of Vazart.co that could delay delivery, such as any event of force majeure or fortuitous event.
It is understood that any person found at the address where delivery is to be made will be duly authorized by the Customer to receive their order. Consequently, Vazart.co is exempt from any responsibility for the delivery made, provided that it is made to the address registered on the Site.
If the order is not received at the indicated address after 3 (three) visits by the carrier, Vazart.co will proceed with the return of the products. In this case, the Customer will be obliged to contact the Site within a maximum period of three (3) calendar days for re-shipment, in which case the shipping and insurance costs incurred will be borne by the Customer, and until they are paid, Vazart.co will not be obliged to dispatch again.
If the Customer does not proceed to request re-shipment within the indicated period, or does not pay the additional value for re-shipment, Vazart.co may withdraw from the business, and will only be obliged to refund the amount paid for the products and/or services, discounting the value of the expenses incurred for transportation.
Returns and Exchanges
In accordance with the provisions of the Colombian Consumer Statute, Vazart.co will proceed to accept repairs and returns of purchased products that are defective and/or whose quality deficiency is not suitable for their intended use, according to the parameters of the guarantees granted by the respective producer. Vazart.co will have 30 business days to make changes and/or returns, which will be counted from the moment the Customer submits their claim. In the aforementioned events, shipping costs will be borne by Vazart.co
9.1 Vazart.co Exchange Policies
For products without a warranty, Vazart.co may, at its discretion, proceed with an exchange or accept a return. Vazart.co will only be obliged to accept exchanges or returns of products without a warranty when, at the time of delivery of the respective product, it is determined that it does not correspond to the characteristics displayed on the Site, or that it is damaged. Provided that the request for exchange or return is due to causes not attributable to Vazart.co, the credit granted for the respective exchange or return will amount to the net value, excluding the value of transportation, insurance, and taxes generated, which must be assumed by the Customer.
In case of an exchange or return of the order by Vazart.co, the Customer will be notified first by email; if there is no response within five (5) business days, they will be notified by telephone at the contact number provided at the time of registration.

11. Right of Withdrawal
In accordance with the Consumer Statute, the Customer may not exercise the right of withdrawal for VazART products, as they are for personal use.
Disclaimer and Warranties
In accordance with current regulations in the Republic of Colombia, the material contained on the Site, including, without limitation, texts, graphics, links, are provided on an "as is" basis, without any warranties of any kind, whether express or implied, including, but not limited to, warranties of fitness for a particular purpose that do not contravene or violate third-party rights.
Vazart.co warns Users that the information on the Site may contain errors or inaccuracies, or not be complete or up-to-date. Therefore, Vazart.co reserves the right to correct any error, omission, or inaccuracy, change or update it at any time and without prior notice.
Exemption from liability and limitation of liability
By accessing the Site, the User expressly accepts that its use is at their sole responsibility and risk.
Neither Vazart.co nor its respective employees and associated third parties guarantee that the use of the Site will be uninterrupted or error-free. Under no circumstances will Vazart.co or its related parties be liable for any direct, indirect, unforeseen, special, or consequential damages generated, whether due to the use or inability to use the Site, including damages arising from their reliance on information obtained on the Site that causes errors, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any other type of error in its operation.
Without prejudice to what is determined in the mandatory rules of applicable Colombian legislation, Vazart.co assumes no responsibility or liability arising from any damage or prejudice, including, but not limited to, loss of information or profits, existence of viruses, results of the use or inability to use the material on this site, lost business opportunities, or any other damage, even if the User has been advised of the possibility of such damages, or for any third-party claim, except as expressly stipulated herein.
Under the terms indicated here, Vazart.co assumes no responsibility for the information provided on the page, including, but not limited to, that related to products and/or services, notes of interest, opinions, practical advice, and resolution of concerns. Vazart.co assumes no responsibility for problems or the impossibility of using the Site or any of its pages, including but not limited to events such as server or connection problems, interruptions in communication, technical problems.
In the event that the use of the material on this site results in the need to service, repair, or correct equipment or information, the User must assume any cost arising therefrom.
The preceding limitation of liability will apply to all legal actions, even if Vazart.co's authorized representative has been informed or previously had knowledge of such damages.
Intellectual Property Rights
All computer, graphic, advertising, photographic, multimedia, audiovisual and/or design material, as well as all content, texts and databases (hereinafter "the Contents"), made available to Users on the Site are the exclusive property of VazART, or of third parties who have authorized their use and/or exploitation.
Likewise, the use of certain third-party owned content is expressly authorized by Law and is protected by copyright and trademark laws and by all applicable national and international regulations.
Any act of copying, reproduction, modification, creation of derivative works, sale or distribution, display of the Contents, in any manner or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or any other kind, without the prior written permission of Vazart.co or the copyright holder, is prohibited.
In no case do these Terms and Conditions confer rights, licenses and/or authorizations to perform the acts described above. Any unauthorized use of the contents will constitute a violation of these terms and conditions and of the current regulations on trademarks, copyrights and/or other applicable national and international intellectual property regulations and will give rise to the corresponding civil and criminal actions.
Advertising and Links
The organizations, products and/or services advertised on the Site as well as the links are not affiliated with or have any relationship with Vazart.co, which plays no role in the production of those products and/or the provision of services and constitutes no guarantee, express or implied, of their content or their suitability for a particular purpose. For example, when the use of any product and/or service is suggested, it is at the User's sole discretion to decide whether to use it, and therefore Vazart.co assumes no responsibility for direct or indirect, certain or eventual, past, present or future damages that may arise from such use.
Thus, transactions that the User carries out with third parties unrelated to the Site based on product and/or service advertisements, as well as visits made to their websites through links, will be at their sole account and risk, without in any way compromising the responsibility of Vazart.co.
Personal Data Protection
By accepting the legal terms and conditions, the User indicates that they know and authorize VazART, its affiliates and related companies, in advance, expressly and informed, so that their personal data may be stored and used in order to achieve efficient communication during the current process or activity, and they also authorize, under the same terms, that said information may be processed in accordance with the provisions of Law 1581 of 2011 and its Regulatory Decrees, in order to receive information about their products, services, offers, promotions, alliances, studies, contests, and content. Likewise, the User has been informed about the personal data protection policy available on the Site, which includes the consultation and claim procedures that allow Users to exercise their rights to access, know, consult, rectify, update, and delete data, and the User may also submit any request related to personal data through the email: holavazart@gmail.com
Disclaimer
As long as the User has not promptly reported the violation of their personal information, or when the User has not notified the corresponding financial or cooperative entities of the loss, misuse, theft, or robbery of the instruments provided by them to carry out transactions, or when their registration data is misused, Vazart.co assumes no responsibility for such actions.
Information Security
18.1. Cookies
Cookies are small data files that websites like Vazart.co .com.ec or emails store in your browser and optionally on your hard drive. Cookies allow us to "remember" information about your preferences and session, and allow the User to navigate within the site areas without re-entering their data.
This makes it possible to create a more personalized and convenient shopping experience. Vazart.co uses a third party to install cookies on the User's computer to collect non-personally identifiable information. Although cookies contain a unique User number, they do not collect or save any personally identifiable information.
Although the User can configure their Internet browser not to accept cookies, these are necessary to view, create an account, or make purchases through the Vazart.co website.

18.2. Linking, Deeplinking, and Framing
Vazart.co prohibits the use of its names and/or logos, trademarks, and any other distinctive signs of its property as hypertext links or in any other way ("links") directed to internet sites whose URL is different from http://www.vazart.co, unless the establishment of such a link is approved by Vazart.co in writing, in which case it must adhere to the design and advertising criteria and manuals established by Vazart.co.
Vazart.co reserves the right to request the removal of links that have been established on websites without its express prior authorization. The establishment of links to subdirectories within the URL http://www.vazart.co .com.ec ("Deeplinking") on pages not controlled by Vazart.co is prohibited.
The display, use, exhibition, copy, or any other form of reproduction of the Site or any of its subdirectories and/or pages, on sites not controlled by Vazart.co ("Framing") is expressly prohibited. Failure to comply with these prohibitions will constitute a violation of intellectual property rights over the content and industrial property rights.

Applicable Law and Jurisdiction

Severability of Provisions
In the event that one or more of the provisions contained in these Terms and Conditions are considered null, illegal, or ineffective in any aspect, the validity, legality, and enforceability or effectiveness of the remaining provisions of this document shall not be affected or annulled by such circumstance.
